Welcome to Code Sprout! These Terms of Service ("Terms") govern your use of the Code Sprout platform ("Code Sprout", "we," "our," or "us"), which aims to make coding education accessible, engaging, and adaptive for everyone, with a special focus on children and underprivileged learners around the world. By accessing or using our services, you ("you," "your") agree to be bound by these Terms.
1. Overview of Services
Code Sprout provides free online educational content focused on coding and programming skills, covering subjects such as web development, app development, programming languages, algorithms, data structures, and more. Our goal is to help everyone, especially underprivileged kids in developing countries, gain access to quality coding education and improve their job prospects in the technology sector.
2. User Eligibility
Our services are available to all users worldwide. However, our primary focus is on underprivileged kids in developing countries who do not have access to quality coding education.
Disclaimer for Users Under 18: If you are under 18 years old (i.e. a child or minor), you must have your parent or guardian's permission to use Code Sprout. By using our services, you confirm that you have received such permission. For users under 18, their parents or guardians are responsible for supervising and controlling access to Code Sprout for them, giving consent on their behalf, and ensuring their adherence to any requirements, rules and restrictions during their use of our services.
Country Restrictions: Access to our services may be restricted in certain countries due to local laws and regulations. It is your responsibility to ensure that your use of Code Sprout complies with the laws of your country.
3. Use of Services
All courses on Code Sprout are completely free of charge. Our services are entirely online, with no physical presence required. We provide an adaptive, individualized curriculum to cater to each student's needs. We may use gamification techniques, such as badges, points, scores, and rankings, to make learning engaging and fun.
To ensure proper use of Code Sprout by children, we require parental approval and supervision. Only adults are allowed to create and manage the child's account, install the App, and submit the necessary information.
To create an account for a child (or minor), an adult must first register with a parent account and create the child's profile with the child's name and year of birth or school grade for content personalization.
Once the account is set up, we only collect the information necessary for the child to fully participate in the educational activities offered by our services. We do not ask for more information than what is required for the child's use of the services. Parents and guardians retain the choice to give appropriate permissions such as device's microphone, camera, location services and push notification.
Parents and guardians can update, correct, and delete your account information through your account settings. Additionally, we use a Parental Gate to prevent children from disclosing personal information online. This feature includes a knowledge-based quiz or an age check or passcode to verify that the user is an adult.
No third party tracking and no targeted advertising. We take steps to avoid the collection of information for behavioral or targeted advertising purposes when we believe the Service is being used by students or children.
4. Parental Involvement and Responsibilities
We encourage parental involvement in their child's education. We provide comprehensive reports for high-touch parents and simple reports for low-touch or illiterate parents. Timely notifications will be sent to keep parents informed of their child's progress. Parents and guardians are encouraged to actively monitor and participate in their child's use of Code Sprout.
Parents and guardians are responsible for supervising and controlling their child's use of Code Sprout. This includes ensuring that their child adheres to these terms and any applicable laws.
By allowing their child to use Code Sprout, parents and guardians consent to the collection, use, and disclosure of their child's personal information as described in our Privacy Policy.
To the fullest extent permitted by law, Code Sprout, its founders, and affiliates will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our services by minors, including but not limited to any unauthorized access to or use of our servers and/or any personal information stored therein, any interruption or cessation of transmission to or from our services, or any errors or omissions in any content.
You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. For users under 18, their parents or guardians are responsible for ensuring account security.
You and/or your parents or guardians must ensure compliance with all applicable laws and regulations while using our services.
You must not engage in any activity that interferes with or disrupts the Services, or that violates the rights of others. This includes, but is not limited to, hacking, spamming, and distributing malware.
5. Content and Intellectual Property
All educational content provided on Code Sprout is owned by us or our content contributors. Users are granted a limited, non-exclusive, non-transferable license to access and use the content for personal, non-commercial purposes. Users must not copy, distribute, modify, or create derivative works from the content without our prior written consent.
We may host contests or competitions ("Contests") from time to time. By participating in and submitting your original work ("Participating Works") to Code Sprout in these Contests, you acknowledge, agree and consent to irrevocably and unconditionally transfer and assign all of your rights in the Participating Works to Code Sprout, which includes, without limitation, your ownership as author of the Participating Works, the right to use, publish or promote the Participating Works at any time during or after the Contests, whether or not your Participating Works is selected as the winning piece in the Contest. For users under 18 who participate in the Contests, their parents or guardians are responsible for giving the required acknowledgement, agreement and consent on their behalf.
6. Privacy and Data Protection
We are committed to protecting the privacy of our users. Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data. Parents and guardians must review and agree to our Privacy Policy on behalf of users under 18.
7. Anti-Cheat Mechanisms
To ensure the integrity of our educational platform, we may use various anti-cheat mechanisms, including:
- Facial Recognition: Random facial recognition checks to verify your identity.
- Timing Heuristics: Analysis of timing patterns to detect bots.
- AI Screening: Use of AI to screen out AI-generated answers.
8. Changes to Terms
We may update these Terms from time to time. We will notify users of any significant changes by posting the new Terms on our platform. Continued use of our services after such changes constitutes acceptance of the new Terms.
9. Liability
The educational content provided on Code Sprout is for informational purposes only. We do not guarantee the accuracy, completeness, or usefulness of any content. Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied.
To the fullest extent permitted by law, Code Sprout, its founders, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from our services; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the services; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.
10. Governing Law and Dispute Resolution
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Code Sprout is based, without regard to its conflict of law principles.
Dispute Resolution: Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the relevant arbitration body in the jurisdiction of Code Sprout.
11. Termination
We reserve the right to terminate or suspend your access to our services at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users of the services, us, or third parties, or for any other reason.
12. Miscellaneous
Entire Agreement: These Terms constitute the entire agreement between you and Code Sprout regarding the use of our services.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
